EULA - End User License Agreement

Software Licensing Arreement for Software Midi Keyboard
This Software Licensing Agreement (hereinafter called "the Agreement") is a legal agreement between you, the end-user, and Midimass Production.The software licensed under this Agreement is the computer program named Software Midi Keyboard (hereinafter called "the Software"), which consists of executable files, data files and documentation, including, without limitation, all code, data structures, images, sounds, text, screens and help information. By installing the Software, by loading or running the Software, by placing or copying the Software onto your hard drive, or by distributing the Software, you agree to be bound by the terms of this Agreement. These are the only terms by which Midimass Production permits use or copying of the Software.
GENERAL PRODUCT LICENSING
1. Midimass Production grants you the right to use the Software in accordance with the terms of this Agreement. You may load the software into RAM as well as install it on a hard disk or other storage device. You may not modify, translate, disassemble, decompile, reverse-engineer or use any similar process on the Software except as permitted by law.
2.You may create midi files, skins or music patterns for the Software solely for your own personal non-commercial home-entertainment use, with the exception that Midimass Production may accept new application features for commercial use subject to agreement of terms with the creator(s) of the new application features.
3.The Software is intended solely for personal non-commercial home-entertainment use.
4. You agree that you will not utilise the Software in violation of any applicable law.
5.The Software, including, without limitation, all code, data structures, images, sounds, text, screens, help information and all other elements of the Software may not be copied, resold, rented, leased, distributed (electronically or otherwise), used on a pay-per-play, coin-op or other for-charge basis, or for any commercial purpose.
6.Any permissions granted herein are provided on a temporary basis and can be withdrawn by Midimass Production at any time.
7.All rights not expressly granted are reserved.
8.Midimass Production and its licensors retain all right, title and interest in the Software including all intellectual property rights embodied therein and derivatives thereof.
9.By acquiring and retaining the Software, you assent to the terms and restrictions of this limited licence. By installing, copying, or otherwise using the Software or any updates, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install the Software.
10.To the maximum extent permitted by applicable law, the Software is provided "as is" without warranty of any kind.
11.To the maximum extent permitted by applicable law, in no event shall Midimass Production or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business time, business profits, business information, or any other kind of loss) arising out of the use of, or inability to use the Software, or the failure to provide support services, even if Midimass Production or one of its suppliers has been advised of the possibility of such damages.
12.Midimass Production entire liability shall not exceed the price paid for the Software.
13.The term of this licence is perpetual. You may terminate this Agreement at any time by destroying all copies of the Software in your possession. Your license to use the Software will automatically terminate if you breach the terms of this Agreement.
14.This Agreement is the sole and entire Agreement relating to the subject matter hereof, and supersedes all prior understandings, agreements, and documentation relating to such subject matter.
15.If any provision in this Agreement is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remaining provisions will continue in full force without being impaired or invalidated in any way.
16.This Agreement does not create any agency or partner relationship. Your rights under this Agreement are personal and do not include any right to sub-license the Software.

All other copyrights and trademarks are property of their respective owners.
The Software is owned by Midimass Production and is protected by copyright laws and international treaties. You must treat the Software like any other copyrighted material, except that you may make copies only of the free trial version of the Software to give to other persons only under the terms of this Agreement. You may not distribute copies of the registered version to others. Except as expressly licensed by Midimass Production in writing, Midimass Production reserves the exclusive copyright and all other rights, title and interest to distribute the Software, and to use Trademarks in connection with them. "Trademarks" refers to the name of the Software, the name Midimass Production, the name Midimass Software, the Midimass Production logo which are trademarks of Midimass Production.
